Foreclosure Stoppers

We Tell You What Your Mortgage Lender Won't.

Foreclosure Legalese

KNOW YOUR RIGHTS - EVEN THE SCALES

When you are in foreclosure, your mortgage lender will sue you for outstanding mortgage payments and costs that pertain to your property.  They will accomplish this by filing a foreclosure complaint with the court, obtaining a default judgment and scheduling your property for Sheriff's Sale.  This process could take as little as five months, if you do nothing.

You have every legal right to challenge the foreclosure, and by doing so, you're gaining the opportunity to save your home and your credit.  In concert, we'll work with you and our attorneys, who know how to challenge the mortgage company and assert your rights.  They know how to challenge the evidence that a mortgage lender can or may present.

A few examples of unacceptable evidence:

  • There may be defects in the documents, such as misinformation.
  • Errors in the processes or procedures taken or followed by your mortgage lender.
  • The mortgage may have been sold or assigned at some point in time and all data may not have been correctly transmitted, leading to incorrect mortgage documents.

BENEFITS

Our experience demonstrates that by challenging the mortgage lender and asserting your rights, the case can take up two years.  Mortgage lenders process thousands of mortgage documents, any of which may contain errors or irregularities.  Most consumers do not understand that they have the legal right to defend themselves when they are sued by their mortgage lender.  The right to do so is given to each of us by our constitution.  The legal process allows you to review all documentation associated with the mortgage and challenge it, if there are any irregularities.  The court process could take up to two years before a final decision is issued.

While we are asserting your rights, the mortgage lender will not accept any mortgage payments from you.  Although this is an unintended benefit, just imagine what could be accomplished during this time of up to two years. It gives you an opportunity to reogranize your life and financial situation without diverting any income to mortgage payments.  Be better prepared for the future, the next step.
